General Terms and Conditions (GTC) – Gemini Salzburg

1. Scope
These General Terms and Conditions govern participation in Gemini Salzburg's training, consulting, and support programs, as well as sales through our online shop. Any deviating terms and conditions must be communicated in writing prior to the conclusion of the contract. In B2B transactions, any deviating terms and conditions apply prior to the conclusion of the contract.
2. Registration and conclusion of contract
Registrations can be made in writing, online, or in person and are binding. All required information must be provided in full. Minors require the written consent of their legal guardian. An invoice serves as confirmation of registration. Changes of address must be notified in writing. The registration deadline is generally 7 days before the start of the course. Later registrations are possible, but timely delivery of the training materials cannot be guaranteed.
3. Prices and taxes
All prices are in euros and include statutory VAT. Discounts must be requested upon registration. B2B offers are shown without VAT. The participation fee is due regardless of full participation. Missed course units or premature termination do not entitle you to a refund.
4. Terms of payment
The participation fee is due no later than 14 days before the start of the course. Late payment may result in late payment fees. Installment payments are only possible after written agreement. Outstanding amounts may be transferred to a debt collection agency.
5. Withdrawal and cancellation conditions
According to the Distance Selling and Doorstep Selling Act (FAGG), the contract can be canceled within 14 days of conclusion without giving any reason. After that, the following cancellation fees apply:
- Up to 14 days before the start of the event: free cancellation
- Up to 7 days before the start of the event: 50% of the participation fee
- Less than 7 days before the start of the event: 100% of the participation fee
Different cancellation policies for specific courses or training programs will be announced separately in the respective course information. Cancellations must be made in writing.
6. House rules
The posted house rules are part of the terms of use and must be observed by all course participants, employees and members.
7. Changes to the event program
Gemini Salzburg reserves the right to make changes to course locations, dates, or instructors, provided these are reasonable. If legal or regulatory requirements require a change in the course format (e.g., from in-person to online instruction), the adjustment will be made without right to cancellation or refund.
8. Implementation
The course is subject to a minimum number of participants. If participation is too low, the event may be canceled. In this case, any fees already paid will be fully refunded.
9. Lessons and small groups
Each lesson lasts 50 minutes, unless otherwise agreed. Information on small group formats will be announced separately. The order of the teaching content may be adjusted for organizational reasons.
10. Computer use and copyright
The use of IT equipment is permitted solely for course purposes. The storage or distribution of illegal content is prohibited. Access data must be treated confidentially. Participants are liable for any damage caused by improper use.
11. Confirmation of participation and examinations
A certificate of participation will be issued upon successful completion of the exam, providing a minimum attendance of 75%. Certificates or diplomas will be issued upon successful completion of the exam. Duplicates can be requested for a processing fee.
12. Data protection
Gemini Salzburg's privacy policy applies and is available on the website at any time. Personal data is processed in accordance with legal regulations and will not be shared with third parties unless legally required to do so.
13. Liability
No liability is assumed for participants' personal belongings. Claims for damages are excluded unless the damage was caused intentionally or through gross negligence. Gemini Salzburg assumes no liability for printing or typographical errors in publications or online media.
14. Place of jurisdiction and choice of law
The place of jurisdiction is Salzburg. Austrian law applies. Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
Terms and Conditions for the Online Shop
15.1. Conclusion of contract
Products can be collected using the "Add to Cart" button and ordered using the "Buy" button. An automatic order confirmation via email does not constitute acceptance of the contract. The contract is only concluded upon a separate order confirmation or delivery of the goods.
15.2. Prices and shipping costs
All prices are quoted in euros and include statutory VAT. Shipping costs will be shown during the ordering process. Orders over the value of 50 euros are delivered free of charge to Austria and Germany.
15.3 Payment and retention of title
Payments can be made via PayPal, credit card, direct bank transfer, or advance payment. The goods remain the property of Gemini Salzburg until full payment is received.
15.4 Delivery and availability
The delivery period begins upon order confirmation. If a product is unavailable, the customer will be informed immediately and can withdraw from the contract. Any payments already made will be refunded.
15.5 Right of withdrawal and revocation
Customers have the right to withdraw from the contract within 14 days of receiving the goods without giving any reason. The customer bears the return shipping costs. The withdrawal form is available on the website.
